Montana has historically been the notable exception among states that license money transmitters. The Division of Banking and Financial Institutions is still the office that would supervise any current or future money-services authority. Do not treat Montana as an open market without reading the current statute.
Confirm with the Division whether a money-transmitter application is required for your model today. FinCEN MSB registration still applies if you meet the federal definition.
FinCEN MSB registration and the Bank Secrecy Act are federal duties. They never substitute for a required state money-transmitter license. Unlicensed money transmission can also be a federal crime under 18 U.S.C. § 1960.
